General Terms & Conditions

These General Terms & Conditions (hereinafter 'Terms') constitute a legally binding agreement between you and relevant Axora Realty entity (hereinafter 'Axora Realty/We/Us/Company') regarding your use of the web application/website  www.AxoraReality.com  hereinafter 'Site') and any Services offered or made available by Axora Realty, including delivery of content via the Site or through any mobile or internet-connected device (hereinafter 'Services'). Additionally, these Terms shall be applicable on all subsidiaries of Axora Realty Services Limited and all other entities/ Services where Axora Realty has significant Control.

Your use of the Site and Services and tools are governed by the following Terms which are incorporated herein. By mere use of the Site, you shall be contracting with Axora Realty. These Terms including the policies constitute your binding obligations with Axora Realty, therefore, it is imperative that before using the platform you acquaint yourself regarding the applicability and consequential application of these Terms.

When You use any of the Services provided by Axora Realty through the Platform, including Product Reviews, Seller Reviews etc., you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such Services, and they shall be deemed to be incorporated into these Terms and shall be considered as part and parcel thereof.

Axora Realty reserves the right to amend or modify these Terms without any prior notice or intimation. Such modifications shall become effective immediately upon being posted on the Site. You are advised to review the Terms periodically to remain informed of any changes. Any further access to the Site after such modifications shall constitute your conclusive acceptance of the revised Terms.

Axora Realty also reserves the right to temporarily suspend operations of the Site for maintenance, technical upgrades, content updates, or any other purpose, without prior notice to the user.

 

I. Defined Terms:

Unless otherwise specified, the capitalized words shall have the meanings as defined herein below:

  1. "Agreement" refers to the completed application form, its attachments, and these Terms. It shall be deemed to have been executed at New Delhi.
  2. "Axora Realty" refers to Axora Realty Services Limited, an Axora Realty incorporated under the Companies Act, 1956, having its registered office at Express Building 9-10, Bahadurshah Zafar Marg, ITO, New Delhi - 110002 or in case of Axora Realty Tech Innovation Private Limited, having its registered office at Times Centre (Digital Content Production Facility), FC-6 (Third Floor), Sector 16A, Film City, Noida – 201301, U.P., including its unit operating the website AxoraReality.com.
  3. "Date of Commencement" is the date indicating the acceptance of the application by the User to the Services.
  4. "Date of Termination" is the date of expiry mentioned in the notice or/and the letter of termination and/or the date when the Services are supposed to end.
  5. "AxoraReality.com" is defined as the internet website or mobile application of Axora Realty at www.axorarealty.com (hereinafter 'Site').
  6. "My Subscriptions" refers to the section providing descriptions and details of the Services availed by the User, either on the website or otherwise communicated in writing by Axora Realty.
  7. "Registration Data" is the database of all the particulars and information supplied by the User on initial application and subscription, including User name, contact details, mailing address, account details and any other information supplied.
  8. "User / You" includes any Subscriber, Advertiser, Browser, or Visitor either an individual or a juristic personality, whose details are captured in the application form, and includes their successors and permitted assigns. It also includes any person accessing or using Services for hosting, publishing, listing, transacting, or viewing information, or otherwise participating in any manner.
  9. "Confidential Information" shall mean any and all non-public, proprietary, technical, financial, strategic, commercial, operational or business-related information, data, documents, trade secrets, know-how, customer lists, pricing strategies, product designs, marketing plans, and any other information disclosed by Axora Realty or its affiliates, in any form or medium (whether oral, written, digital or otherwise), whether marked as confidential or not, to the other party in connection with the Terms.
  10. "Words importing the masculine shall include the feminine; the singular shall include the plural and vice versa; and references to persons include individuals and both incorporated and unincorporated entities.

 

II. Services:

Axora Realty provides various internet-based Services through its platform, including:

  1. Posting property listings and User profiles for sale, rent, or related Service.
  2. Searching for properties via AxoraReality.com and its associated links.
  3. Placing print advertisements in group publications through the platform.
  4. Posting online advertisements.
  5. Sending promotional messages via email or SMS.
  6. Other Services as mentioned on the Site or as stated in these Terms.

Services may be purchased through available payment options and are subject to applicable policies, including subscription fees, refunds, and cancellations.

 

III. Eligibility:

You represent and warrant that you are at least 18 years of age and competent to enter into a valid and binding contract apart from being capable of entering, performing, and adhering to these Terms. Minors may use the Service only under the supervision of a parent or legal guardian through the guardian's registered account. You agree to register before uploading content or accessing Service, and to provide accurate personal details, including name, age, email, address, and contact number.

 

IV. Subscription Fees

  1. The applicable Subscription Fees shall be as specified on the "My Subscriptions" page or as notified by Axora Realty from time to time.
  2. Subscription Fee liability shall commence from the Date of Commencement.
  3. Users accessing or posting property listings for purchase purposes are exempt from this clause, unless otherwise notified by Axora Realty.
